TOOLPORT LIMITED WARRANTY
Toolport US, Inc. (“Toolport”) provides this Limited Warranty.
BY ORDERING OR PURCHASING ANY TOOLPORT PRODUCT FROM A TOOLPORT-OPERATED WEBSITE, TOOLPORT TELEPHONE SALES LINE, AUTHORIZED TOOLPORT MARKETPLACE STOREFRONT, OR OTHER AUTHORIZED TOOLPORT SALES CHANNEL WITHIN THE UNITED STATES (COLLECTIVELY, A “TOOLPORT STORE”), YOU AGREE TO BE BOUND BY THE TERMS OF THIS LIMITED WARRANTY (“WARRANTY”).
A “TOOLPORT PRODUCT” MEANS ANY PRODUCT MANUFACTURED FOR OR DISTRIBUTED BY TOOLPORT US, INC. AND SOLD THROUGH A TOOLPORT STORE.
THIS WARRANTY APPLIES ONLY TO TOOLPORT PRODUCTS PURCHASED FROM A TOOLPORT STORE AND IS VALID ONLY FOR THE ORIGINAL PURCHASER. PRODUCTS PURCHASED FROM UNAUTHORIZED SELLERS OR RESELLERS ARE NOT COVERED BY THIS WARRANTY.
IF YOU DO NOT AGREE TO THE TERMS OF THIS WARRANTY, DO NOT PURCHASE, ORDER, OR USE THE TOOLPORT PRODUCT. IF YOU HAVE ALREADY PURCHASED THE PRODUCT AND DO NOT AGREE, YOU MUST RETURN IT WITHIN THE RETURN PERIOD, AND ACCORDING TO THE TERMS, STATED IN TOOLPORT’S RETURN POLICY.
1. WARRANTY COVERAGE AND WARRANTY PERIODS
This Warranty applies only within the United States and only to Toolport Products purchased from a Toolport Store. This Warranty is valid only for the original purchaser or original end user of the Toolport Product and is non-transferable.
“Commercial Use” means use of a Toolport Product in connection with any trade, business, agricultural operation, rental activity, resale activity, institutional use, governmental use, or other revenue-generating enterprise.
1.1 GENERAL ONE-YEAR COVERAGE (ALL TOOLPORT PRODUCTS)
Toolport warrants that each Toolport Product will be free from defects in materials and workmanship for a period of one (1) year from the date of purchase (as shown on the original receipt) or the date of delivery, whichever occurs later (“Warranty Period”), when used under normal conditions and maintained according to the assembly, installation, use, and maintenance instructions provided with the Toolport Product at the time of sale.
1.2 EXTENDED COVERAGE FOR CERTAIN GREENHOUSE COMPONENTS
For aluminum-frame, polycarbonate-panel greenhouse Toolport Products, extended Warranty Periods apply solely to the specific components identified below. These extended periods apply only to the listed components incorporated into a greenhouse Toolport Product and do not apply to the greenhouse as a whole.
The extended Warranty Periods described in this Section 1.2 apply only to greenhouse Toolport Products used for personal, residential, or non-commercial purposes. Use of a greenhouse Toolport Product for Commercial Use voids the extended Warranty Periods set forth in this Section 1.2; however, such products remain subject to the standard one (1) year Warranty Period described in Section 1.1.
(a) Aluminum Frame
Toolport warrants that the aluminum frame structural components incorporated into a greenhouse Toolport Product will be free from defects in materials and workmanship for fifteen (15) years from the date of delivery.
This extended coverage applies only to manufacturing defects affecting structural integrity. It does not cover damage resulting from improper assembly and/or installation, insufficient anchoring, misuse, alteration, overloading, snow accumulation, wind, hail, chemical exposure, environmental conditions, or failure to follow the assembly, installation, use, and maintenance instructions provided with the Toolport Product at the time of sale.
Damage resulting from environmental loads, including wind or snow accumulation, is not considered a defect in materials or workmanship.
(b) Polycarbonate Glazing Panels
Toolport warrants that the polycarbonate panels incorporated into a greenhouse Toolport Product will be free from defects in materials and workmanship for ten (10) years from the date of delivery, provided the panels are installed, handled, and maintained in accordance with the assembly, installation, use, and maintenance instructions provided with the Toolport Product at the time of sale.
This coverage applies to manufacturing defects affecting structural integrity. It does not cover normal aging, surface scratching, cosmetic changes, discoloration due to environmental exposure, improper cleaning, improper assembly and/or installation, storm damage, or other external causes.
(c) All Other Greenhouse Components
Except as expressly provided above, all other components and parts of a greenhouse Toolport Product remain subject to the standard one (1) year Warranty Period.
2. WHAT THIS WARRANTY DOES NOT COVER
This Warranty does not cover:
- Normal wear and tear;
- Cosmetic damage, including scratches, fading, or discoloration;
- Damage caused by weather, including but not limited to wind, hail, storm, snow, flooding, or other natural events;
- Assembly of a Toolport Product does not void this Warranty; however, improper assembly or installation not in accordance with the provided instructions voids coverage for any resulting damage;
- Improper ballasting, staking, anchoring, or site preparation;
- Misuse, abuse, neglect, accident, vandalism, or theft;
- Alterations, modifications, or use of non-Toolport replacement parts or accessories;
- Improper cleaning, chemical exposure, or failure to follow instructions;
- Commercial Use solely with respect to the extended greenhouse component warranties described in Section 1.2, unless expressly authorized in writing by Toolport;
- Any indirect, incidental, special, or consequential damages;
- Use of any Toolport accessory, component, replacement part, or add-on product in connection with non-Toolport Products.
Toolport accessories and components are exclusively for use with Toolport Products. Any use of Toolport accessories or components with non-Toolport products voids this Warranty with respect to the accessory or component.
Any damage or loss resulting from improper setup, inadequate anchoring, incorrect orientation, overcrowding, site conditions, or user error is the sole responsibility of the purchaser.
Toolport reserves the right to deny claims that do not fall within the scope of this Warranty.
3. WARRANTY CLAIM PROCESS
To make a claim under this Warranty, you must contact Toolport within the applicable Warranty Period.
Claims must be initiated through our warranty department at [email protected].
You may be required to provide:
- Proof of purchase
- Proof of delivery date
- Clear photographs of the alleged defect and date the alleged defect occurred
- Location of the product at the time the alleged defect occurred
- Photographs showing the complete assembly and/or installation
- Any additional information reasonably requested by Toolport
Toolport may require return of defective parts or components. Return shipping instructions will be provided if required.
4. REMEDIES UNDER THIS WARRANTY
If Toolport determines that a valid claim exists under this Warranty, Toolport will, at its sole discretion:
- Repair / provide materials to repair the defective component;
- Provide replacement parts;
- Replace the Toolport Product or affected component with the same or a substantially similar product; or
- Refund the original purchase price.
These remedies are the purchaser’s sole and exclusive remedies under this Warranty.
Any repair or replacement does not extend, renew, or restart the applicable Warranty Period.
Any refund issued under this Warranty applies only to the original purchase price paid for the defective Toolport Product and does not include shipping fees, installation costs, assembly costs, or other incidental expenses.
5. EFFECT OF RETURN OR REFUND ON WARRANTY COVERAGE
If a Toolport Product is returned or refunded under any Toolport Store Return Policy, this Warranty automatically terminates with respect to that Toolport Product as of the date the refund is issued.
Any refunded Toolport Product is no longer eligible for warranty coverage, including repair, replacement, or additional refund claims.
Any chargeback, payment reversal, or disputed transaction suspends this Warranty during the pendency of the dispute.
If the dispute is resolved in Toolport’s favor and payment is fully restored, warranty coverage shall resume, subject to the remaining applicable Warranty Period.
If the dispute is resolved in the customer’s favor or results in a refund to the customer, this Warranty shall be permanently void, and no further warranty coverage shall apply, regardless of any subsequent repayment, unless expressly agreed to in writing by Toolport.
6. ACCESSORY AND COMPATIBILITY LIMITATION
Toolport accessories, replacement parts, and add-on products (including but not limited to carry bags, anchoring systems, connectors, covers, and structural components) are designed and tested exclusively for use with Toolport Products.
Use of any Toolport accessory or component with a product that is not manufactured or sold by Toolport automatically voids this Warranty with respect to that accessory or component.
Toolport makes no representation or warranty regarding compatibility of its products with non-Toolport products and disclaims any liability arising from such use.
7. DISCLAIMER OF OTHER WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THIS WARRANTY AND THE REMEDIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED.
TOOLPORT DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TO THE EXTENT PERMITTED BY LAW.
IF IMPLIED WARRANTIES CANNOT BE DISCLAIMED UNDER APPLICABLE LAW, ANY SUCH IMPLIED WARRANTIES ARE LIMITED IN DURATION TO THE APPLICABLE WARRANTY PERIOD SET FORTH ABOVE.
8. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOOLPORT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF USE, LOSS OF PROFITS, LOSS OF REVENUE, OR LOSS OF PROPERTY.
TOOLPORT’S TOTAL LIABILITY SHALL NOT EXCEED THE ORIGINAL PURCHASE PRICE PAID FOR THE TOOLPORT PRODUCT.

10. GENERAL PROVISIONS
This Warranty is separate from and in addition to any Toolport Store Return Policy. Eligibility for return under the Return Policy does not determine eligibility for coverage under this Warranty, and vice versa.
This Warranty supersedes any warranty statements that may appear in manuals, packaging, marketing materials, or other documents.
If any provision of this Warranty is found to be unenforceable, the remaining provisions shall remain in full force and effect.
This Warranty shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles, except to the extent prohibited by applicable consumer protection laws.
